III. Conclusion

The western checkerboard and UIA reflect a storied period of our history. Whatever the UIA’s merits today, it—and the case law interpreting it—remain good federal law. Bergen, 848 F.2d at 1506. Applying that law here, Iron Bar cannot implement a program which has the effect of “deny[ing] access to [federal] public lands for lawful purposes[.]” Id. at 1509 (internal quotation omitted).

So the district court was correct to hold that the Hunters could corner-cross as long as they did not physically touch Iron Bar’s land.

We affirm.

I think this will go all the way to the Supreme Court. The land owner ( and others who own big properties) have deep pockets and this ruling is really consequential.

This is only legal in 6 states. Montana and Idaho are not part of the 10th circuit court.
atleast that is what was explained to me on another forum.

The landowner has appealed the decision in the appeals court to the Supreme Court.

Not over yet. There is a chance the Supreme Court does not take the case and the decision that legalizes corner crossing stands.

Yeah, this battle will be drawn out, in every way imaginable. All I want is a clear ruling, once we have that then life can move on.

If legalized the battle is going to be over whether or not people are crossing at the actual corners. That will get interesting very quickly. My prediction is areas like the i-80 corridor in Wyoming will go under intense scrutiny for land swaps to get rid of headaches.
